Who’s to Blame?
The law basically says that the person responsible for where the trip, or slip took place, should have done everything possible to ensure the people were made aware of the problem (think about those signs you see in supermarkets when liquid is on the floor) and repaired it as soon as possible. In other words, a degree of negligence has to be proven.
And the law also recognises that in the case of pavements and roads, the local authorities, who usually are responsible for such areas, cannot be perfect 100% of the time.
